NYE Digital Academy ("NYE", "we", "us",
"our") is a digital learning platform that offers technology courses
to help our learners (“User”, “you”, “your”) develop in-demand skills, enhance
their career prospects, and stay competitive in today’s fast-evolving digital
landscape. Our
platform provides accessible, flexible, and high-quality learning experiences
in areas such as software development, data science, digital marketing, and
other technology-driven disciplines (our “Services”).
This Privacy Policy describes your privacy
rights regarding how and when NYE collects, uses, stores, shares and protects
your information across our website and Applications (“Apps”).
This Privacy Policy is applicable to the
website and applications (“Apps”) of NYE.
NYE’s Privacy Policy is embedded in the

Account: means your account which you will open on our
platform to access the technology courses.

account log-in information, IP addresses, web traffic, number of times you
visit, browser type and version, device details, date and time of visits.

Data Breach: refers to the unauthorized access or
acquisition of computerized data that compromises the security, confidentiality
or integrity of personal information;

Data Processing: means any operation or set of operations in
relation to such data, whatever the mechanism used, especially the obtaining,
recording, organization, retention, adaptation or alteration, retrieval,
consultation, use, disclosure by transmission, dissemination or otherwise
making available, alignment or combination, blocking, deletion or destruction;

Data Protection Officer: refers to the individual that has been
assigned responsibility of managing the data protection program at NYE;
4.6.
Personal Information: Any information that can be used to identify
a living person including email address, name, password and address. It may
also include anonymous information that is linked to you, for example, your
internet protocol (IP), log-in information, address, location or device.

Sites: means any platform including but not limited
to mobile applications, websites, and social media platforms.
4.8.
NYE means NYE Digital Academy.
4.9.
User: means an individual who uses the Services or
accesses the Sites and has agreed to use the Services.

Personal Information by using our Services. You also have the choice at any

(NDPA) and the Nigeria Data Protection Regulation, below are the rights you

held by us by signing into your Account or contacting us.
10.3.
Right to request that NYE erase your Personal Information; You have the right to ask
us to erase your Personal Information. Please note that this is a limited right
which applies where the data is no longer required, or the processing has no
legal justification or we are not required by law to retain your information.
The exceptions to this right is where the applicable law requires NYE to retain a historical archive or where we retain a core
set of your personal data to ensure we do not inadvertently contact you in
future where you object to your data being used for marketing purposes.

provide which may be incorrect, out of date or inaccurate. You also have the
right to ask us to complete information you think is incomplete.

Right to object to processing: You have the right to object to the

circumstances, provided that you understand that the exercise of this right

NYE maintains organizational, technical and
administrative measures designed to protect Personal Data covered by this

know such information and further implement security practices and procedures
designed to protect the confidentiality and security of such information and
prohibit unlawful disclosure of such information in accordance with our

for your NYE Account. If you have reasons to believe that your interactions

anticipate providing Services to you and in accordance with the provision of
the Nigerian Data Protection Act 2023.
For compliance reasons, we may further retain

any other country where we maintain facilities;

including personal information to a country and jurisdiction that does not have

NYE’s database;

ensures that personnel who collect, access and process Personal Information

necessary knowledge, skills and competence required to effectively manage the
compliance framework under this Policy, the NDPA and the NDPR with regard to
the protection of Personal Information.

Periodically, NYE will grant access to the Nigeria Data Protection
Commission (NDPC) established by the NDPA for the monitoring, investigation,
report on the observance and promotion of the protection of the right to
privacy and of personal data.
Periodically, we may change, amend, or review this Privacy Policy to
reflect new services or changes in our Privacy Policy as guided by regulatory
requirements. All changes made will be posted on this page and where changes
will materially affect you, we will notify you of this change by placing a
notice on our website. If you keep using our Services, you consent to all
amendments of this Privacy Policy.

Disputes Resolution and Filing of Complaints
Where any of your rights as provided for under
this Notice is breached, resolution shall be in accordance with the provision
of our Terms of Use, provided that you can only apply for a remedy within a
period of 2 years within which the breach occurred.

Governing Law
